United Spirits Challenges FSSAI's Flavouring Norms in High Court

Leading alcoholic beverage manufacturer United Spirits has initiated legal proceedings in the High Court, challenging a recent directive from the Food Safety and Standards Authority of India (FSSAI). The dispute centres on FSSAI's regulations concerning the use of specific flavouring agents in spirits, particularly impacting the company's popular McDowell's No. 1 Rum brand.

The FSSAI's order asserts that flavour profiles typically associated with categories like rum and whisky are not permissible in products classified simply as "spirits." This clarification follows inspections that reportedly uncovered several manufacturers employing neutral alcohol base spirits enhanced with various flavouring agents. Such practices, according to the food regulator, render these products non-compliant with existing food safety standards.

United Spirits' petition in the High Court seeks to challenge this interpretation and application of the food safety norms. The company's move underscores the significant implications for the alcoholic beverage industry, where many popular brands might utilise similar flavouring techniques in their product formulations.

This legal contest could establish a crucial precedent for the labelling and composition of spirits across India. The outcome will likely influence how alcoholic beverages are categorised and marketed, potentially necessitating adjustments in manufacturing processes for numerous brands to align with FSSAI's stringent food safety and labelling mandates.
