Supreme Court Slams Patna HC Ruling on Attempted Rape, Orders Judicial Sensitivity

India's Supreme Court has voiced grave concern over a controversial judgment issued by the Patna High Court, which had ruled that the act of removing a woman's salwar did not amount to attempted rape. The apex court underscored the critical importance of judicial officers thoroughly researching and adhering to its established precedents and judicial sensitivity guidelines in handling cases of sexual assault.

The impugned order from the Patna High Court had sparked widespread debate by asserting that merely undressing a victim, without further overt acts, did not constitute an attempt to commit rape. This interpretation drew sharp criticism, prompting the Supreme Court to intervene and reiterate the fundamental principles guiding the adjudication of such sensitive matters across the nation's judiciary.

During its review, the Supreme Court stressed that judges must exercise due diligence in understanding the nuances of sexual assault laws and ensure their decisions align with the spirit and letter of existing legislation and apex court pronouncements. It highlighted the imperative for all courts to strictly observe judicial sensitivity guidelines, particularly in cases involving crimes against women, to prevent misinterpretations that could undermine justice.

In a significant directive, the Supreme Court instructed that its judicial sensitivity guidelines be disseminated to all courts nationwide for strict compliance. Furthermore, it mandated that state governments issue clear instructions to their respective police departments regarding the meticulous registration of First Information Reports (FIRs) and the proper filing of chargesheets in cases of sexual offences, aiming for uniformity and robustness in legal proceedings.
